Work drug tests still used in states where pot is legal

(WTNH)– A controversy is brewing in states where recreational marijuana is now legal.

Employers are saying they still have a right to drug test. On the law books, employers can even restrict their employees use of pot.

Attorney’s say employers should educated their employees on their companies policies.

“There are some obvious reasons employers should want to test, there may be liability if an employee who is involved in an accident then subsequently tests positive for marijuana- so we encourage that those employers have policies that let employees know they are going to be testing,” said Michael Santo, Lawyer.

Companies can fire an employee who tests positive for marijuana despite it being legal in Colorado.
