New London resident charged because of bamboo grove

NEW LONDON, Conn. (WTNH) — Carlos Carrion is now facing criminal charges after the city says a bamboo grove on his Borodell Place property has grown unruly.

Carrion’s attorney Daryl Finizio, the former Mayor of New London, says his client is accused of willfully doing nothing to comply with a blight citation and order to remediate.

The city says the bamboo on Carrion’s property violates the city’s blight ordinance because it is growing beyond his property.

Finizio says his client has trimmed back the bamboo from his property lines per a written order from the city but he says the city has also sent mixed messages and has verbally told him he also needed to remove it completely or cut it down to ten inches in height.

The thick grove of bamboo stands taller than Carrion’s two story home.

A state statute enacted in 2013 seeks to control running bamboo which it says “has a root system with rhizomes that run underground and can quickly spread from one property to another unless carefully maintained.”

Finizio says Carrion’s bamboo is grandfathered in because it was planted many years before the law was passed.

He says he will be filing ten motions to dismiss the charges against his client who he says has been unfairly targeted by the city.

He also says the city pursued both civil and criminal charges against his client but the blight ordinance allows for either or not both.
